Terms of Service

Welcome to Strada Rider! These Terms of Service ("Terms") govern your use of the Strada Rider website and mobile application (collectively, the "Service"), operated by Strada Rider ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By using Strada Rider, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Strada Rider is a platform that connects users with athletes to motivate and enhance fitness activities through Strava integration. Users can hire athletes for activities like running, cycling, or swimming, while athletes can offer their services to inspire others. The Service integrates with the Strava API to display performance metrics and facilitates payments for bookings.

3. User Accounts

Registration: To use certain features (e.g., hiring an athlete or becoming an athlete), you must create an account by providing accurate information, such as your name, email, and location. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@stradarider.com if you suspect unauthorized use. Profile Information: Athletes must provide truthful performance data and activity history via Strava integration. Users and athletes may upload profile photos, which must comply with our content guidelines (see Section 6).

4. Strava Integration

Strada Rider connects with the Strava API to access and display your fitness data, such as activity type, pace, and history. By using the Service, you authorize us to access your Strava account as permitted by Strava's terms. You can revoke this access at any time through your Strava settings, but this may limit your ability to use certain features of the Service.

5. User Responsibilities

General Conduct: You agree to use the Service in a lawful, ethical manner and in accordance with these Terms. You will not: - Misrepresent your identity, performance data, or activity history. - Engage in harassment, abuse, or discriminatory behavior toward other users or athletes. - Use the Service for any illegal or unauthorized purpose. Booking and Payments: When hiring an athlete, you agree to pay the fees displayed at the time of booking. Payments are processed through secure third-party providers, and you are responsible for ensuring sufficient funds. Athlete Obligations: If you are an athlete, you agree to provide accurate performance data, honor bookings, and deliver services as promised. You must maintain an active Strava account for verification.

6. Content Guidelines

User-Generated Content: You may submit content, such as profile photos, testimonials, or activity uploads. You retain ownership of your content but grant Strada Rider a non-exclusive, worldwide, royalty-free license to use, display, and reproduce this content to operate and promote the Service. Prohibited Content: You may not post content that is: - Inappropriate, offensive, or obscene. - Infringing on intellectual property rights. - False, misleading, or fraudulent. Removal: We reserve the right to remove any content that violates these Terms or is deemed inappropriate at our discretion.

7. Payments and Refunds

Fees: Hiring an athlete incurs a fee, which will be clearly displayed before booking. All fees are non-refundable except as required by law or as outlined in our refund policy. Payment Processing: We use third-party payment processors to handle transactions. You agree to comply with their terms and provide accurate payment information. Disputes: If you have a payment dispute, contact us at support@stradarider.com within 30 days of the transaction. We will work to resolve the issue promptly.

8. Cancellations

User Cancellations: You may cancel a booking up to 24 hours before the scheduled activity for a full refund. Cancellations within 24 hours may incur a fee. Athlete Cancellations: If an athlete cancels, we will notify you and provide a full refund or the option to reschedule with another athlete.

11. Indemnification

You agree to indemnify and hold harmless Strada Rider, its affiliates, and its partners from any claims, damages, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

By You: You may terminate your account at any time by contacting us at support@stradarider.com. Upon termination, your profile and data will be deleted per our Privacy Policy. By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. You will be notified of such actions.

13. Dispute Resolution

Governing Law: These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles. Arbitration: Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in London, UK, under the rules of the London Court of International Arbitration (LCIA). You waive your right to participate in a class action lawsuit.

14. Modifications to the Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. We will notify you of significant changes by posting the updated Terms on our website and, where required, by email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

15. Third-Party Services

The Service integrates with third-party services like Strava and payment processors. These services are subject to their own terms, and we are not responsible for their practices or availability.
